Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the store.houseofcashabella.co.za website (the "Service") operated by House of Cashabella ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

1. Agreement to Terms & Age Restrictions

By accessing or using our website, purchasing products, or engaging our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service. By placing an order, you represent that you are at least 18 years of age, or that you are purchasing under the supervision and consent of a legal parent or guardian.

2. Electronic Communications

By using this website or communicating with us by electronic means (including email or WhatsApp), you consent and acknowledge that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be in writing.

3. Account Security

If you create an account on our website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or mobile device. You agree to accept responsibility for all activities that occur under your account or password. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4. Products, Accuracy & Availability

We strive to display our products, including colors and textures, as accurately as possible. However, the actual colors you see will depend on your monitor or device screen, and we cannot guarantee absolute color accuracy. All products are subject to availability, and we reserve the right to impose quantity limits on any order, to reject all or part of an order, and to discontinue products without notice, even if you have already placed your order.

5. Bespoke & Customized Products

House of Cashabella offers premium personalization services. When ordering customized products, you agree to the following:

• Customer Responsibility: You are entirely responsible for verifying all text, spelling, grammar, and design instructions before submitting your order. We print exactly what is provided to us.
• Image Quality: If uploading a custom image, you must provide a high-resolution file. We are not liable for poor print quality resulting from low-resolution or heavily compressed images.
• Intellectual Property: By uploading an image or text, you warrant that you hold the copyright or have the necessary permissions to use and reproduce the content. You agree to indemnify House of Cashabella against any copyright infringement claims.
• Right to Refuse: We reserve the right to refuse to print any material that we deem offensive, illegal, discriminatory, or inappropriate.

6. Pricing & Payment Security

All prices are quoted in South African Rand (ZAR) and are inclusive of VAT (if applicable). Shipping costs are calculated dynamically at checkout and added to the total order price.

We utilize PayFast, a highly secure, PCI-DSS compliant third-party payment gateway, to process all transactions. House of Cashabella does not store, process, or have access to your raw credit card data or banking PINs. An order is only deemed binding and accepted by us once PayFast successfully clears the funds into our merchant account.

7. Shipping, Delivery & Risk

We partner with The Courier Guy for nationwide fulfillment. Delivery timelines provided are estimates and are not guaranteed. House of Cashabella shall not be liable for any delays resulting from courier logistics, strikes, adverse weather, or inaccurate addresses provided by the customer.

• Transfer of Risk: The risk of loss and title for items purchased pass to you upon our delivery of the items to the carrier (The Courier Guy).
• PUDO Lockers: If you select PUDO locker collection, you are responsible for retrieving the parcel using the provided PIN within the designated timeframe (typically 36 hours). Parcels returned to us due to non-collection will incur an additional shipping fee for redelivery.

8. Returns, Refunds & the CPA

Our return policy operates strictly in accordance with the South African Consumer Protection Act (CPA):

• Standard Merchandise: You may request a return within seven (7) days of delivery if the item is defective, damaged in transit, or significantly not as described. Items must be unused, unwashed, and in their original packaging. Return shipping costs for "change of mind" returns are for the customer's account.
• Customized Goods Exemption: In accordance with CPA regulations, goods made to the consumer's specifications or clearly personalized are exempt from the general right of return. Customized products are strictly non-refundable and non-returnable unless there is a clear manufacturing defect or a printing error made exclusively by our production team.
• Order Cancellations: Orders can be cancelled for a full refund prior to entering the processing or production phase. Once a custom order has entered production, it cannot be cancelled or refunded.

9. Intellectual Property Rights

The Service and its original content, features, functionality, graphics, product designs, and logos are and will remain the exclusive property of House of Cashabella and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of House of Cashabella.

10. Limitation of Liability

In no event shall House of Cashabella, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; and (iii) unauthorized access, use or alteration of your transmissions or content.

11. Indemnification

You agree to defend, indemnify and hold harmless House of Cashabella and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

12. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
